2. Description of Services
DayAI provides a business management platform for service-based businesses, including but not limited to:
- Online booking and appointment management
- Customer relationship management (CRM)
- Team and staff management
- Payment processing (via Stripe)
- Business analytics and reporting
- AI-powered business assistance
- Online shop pages and marketing tools
3. User Accounts
3.1 Business Owners
Business owners must provide accurate business information including business name, address, and contact details. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
3.2 Customers
Customers who use our platform to book services must provide accurate contact information. You agree to honour bookings made through the platform or cancel within the business's cancellation policy.
4. Bookings and Payments
- Bookings made through DayAI are agreements between the customer and the business. DayAI facilitates but is not a party to these transactions.
- Payment processing is handled by Stripe. By making a payment, you also agree to Stripe's terms of service.
- Refund and cancellation policies are set by individual businesses. Please review the business's policy before booking.
- DayAI is not responsible for the quality of services provided by businesses on the platform.
5. Acceptable Use
You agree not to:
- Use the platform for any unlawful purpose
- Provide false or misleading information
- Interfere with or disrupt the platform's operation
- Attempt to gain unauthorised access to other accounts or systems
- Use automated tools to scrape or collect data from the platform
- Transmit harmful code, viruses, or malware
6. Intellectual Property
The DayAI platform, including its design, features, code, and content, is owned by DayAI and protected by intellectual property laws. Business owners retain ownership of their business data and content uploaded to the platform.
7. AI Services
DayAI uses artificial intelligence to provide features such as chat assistance, analytics, and recommendations. AI-generated content and suggestions are provided for informational purposes and should not be considered as professional advice. We do not guarantee the accuracy of AI-generated outputs.
8. Limitation of Liability
To the maximum extent permitted by Australian law, DayAI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount you paid to DayAI in the 12 months preceding the claim.
9. Disclaimer of Warranties
The platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, secure, or error-free.
10. Termination
We reserve the right to suspend or terminate your account if you violate these terms. Business owners may cancel their subscription at any time. Upon termination, you may request export of your data within 30 days.
11. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales.
12. Changes to Terms
We may update these Terms from time to time. Continued use of the platform after changes constitutes acceptance of the updated terms. We will notify users of material changes.
